Taking the right approach to training your legal hires is one of the most important things any employer can do. The right education and guidance sets your employees up for success in any role and ensures they can thrive in your law firm.

What’s more, today’s legal employees crave training more than ever before.

A 2021 global workforce report from Randstad revealed that the vast majority of employees worldwide (especially those in the younger age brackets) believe they need to upskill to keep up with the labour market changes since the beginning of the Pandemic. Some other studies show that around 40% of staff members worry their skills will become outdated in today’s quickly-evolving landscape.

However, according to the same studies, 49% of employees want to enhance their skills but are unsure where to begin, and this correlates with the findings from the aforementioned report, which saw the majority of survey respondents say that they are unsure of which skills to acquire due to the rapid changes occurring in the global workforce.

For those in leadership positions at your law firm, the focus areas for training an initial new legal hire should revolve around developing critical soft skills. Most of your new team members already have the technical talents required for their roles. However, you can always look into upskilling and expanding this knowledge later.

Your legal team members need help with the critical skills that will define their future with your law firm. Here are the three areas you need to focus on.

Skill 1: Goal Setting

Goals are critical in any legal role. According to research from Harvard Business School, people who successfully visualise and write down their professional goals are often 20% more successful. Goals act as a compass in any career, giving direction and guidance to your team members.

Start by providing your legal employees with a clear insight into your firm’s core values and expectations for their work. This will help them monitor and measure their performance to ensure they’re delivering the right results. Next, arrange for a meeting during the onboarding process, where you can set different types of goals with your new team member, such as:

  • Short-term goals: Define what your new employee should be working towards during the first few months of their position in your firm. As a manager, outline what you’d like to see from them, and ask what they would like to accomplish during this time.
  • Long-term goals: Ask about where your employee sees themselves in the future. Do they want to work towards a promotion or a higher-paying role? Together, you can outline a plan for how they can make their targets a reality.
  • Development goals: Where would your employees like to improve their skills or become more proficient during their time with your firm? What training opportunities would they want access to, and where do they feel they need the most help?

It’s also worth providing your employees with key tips on improving their chances of successfully reaching their goals. Discuss the difference between setting realistic and unrealistic targets, and look at how you can help your employee to become more focused.

One option could be to set your new legal team member up with a mentor, so they can constantly get feedback on their progress. It’s also worth having regular meetings with each employee throughout the year to see whether they’re accomplishing their goals and what you can do to assist them.

Skill 2: Relationship Building

Relationships form the foundation of any strong firm culture. Research shows positive relations between employees and their managers and colleagues lead to better job satisfaction, increased retention, and boosted productivity. However, many legal employees struggle with creating the right connections throughout the firm.

During the initial onboarding process, when you’re bringing your new team member into your law firm, introduce them to the people they will be working with. Some bonding activities can be extremely useful during this stage to help with breaking the ice.

Next, provide tips on strengthening your team members’ relationships with colleagues and managers. For instance, you can encourage them to:

Be proactive in offering help: Employees who constantly look for ways to support and assist their other legal team members are more likely to be appreciated by the rest of the team. Encourage your staff to be proactive team players.

Take part in meetings: While not all of your business meetings may be mandatory, many provide networking and communication opportunities. Asking staff members to participate in regular video and in-person meetings will help to strengthen bonds.

Develop emotional intelligence: Training your employees on how to demonstrate good emotional intelligence is fantastic for enhancing their relationship-building abilities. They should be aware of how to recognise and understand the emotions of others.

Communicate constantly: Make sure your legal team has a strong culture of constant communication and collaboration. Everyone should feel included in conversations, and every team member should feel as though they have a voice.

Network whenever possible: Allow team members to attend events and networking opportunities. This is a good way to help them expand their relationships in the legal industry and feel more confident communicating with others.

It’s also helpful to have diversity, equity, and inclusion policies, which highlight how each team member should show respect for their fellow workers. If any of your employees seem to be isolating themselves from the group or show a negative attitude towards others, jump in and see what you can do to fix the problem.

Skill 3: Productivity

All legal employers want productive, efficient, and engaged team members. While the support you give your employees in the form of the right technical skill training and tools will help to enhance productivity, there are also steps employees will need to take themselves.

Ask your staff members how they currently pursue productivity in their workflows and where they’re most likely to struggle. If your team members are working in a remote or hybrid environment, they may need more assistance with scheduling their work and ensuring they adhere to deadlines.

Introduce your employees to different methods of boosting productivity, such as:

  • Arranging their to-do list: Some employees will find it easier to tackle the toughest jobs first thing in the day. Others will prefer to start with easier tasks and work on complex challenges later. Encourage your staff members to discover what works for them.
  • Taking regular breaks: While pushing your employees to be productive at all hours of the day is tempting, we all need breaks. Help your employees to take time out when they need it, by allowing them to step away from their schedule from time to time.
  • Tackling one task at a time: Teach your employees that multi-tasking is rarely the best way to generate the right results when it comes to productivity. Breaking large tasks into smaller pieces and working on targets one at a time is more likely to generate results.
  • Managing energy (not just time): Give your employees the freedom to adjust their work schedule according to when they have the best sense of focus. In today’s hybrid and remote work world, giving your employees more autonomy can boost productivity.
  • Leveraging useful tools: Certain tools and technology in the workplace can assist with productivity. For instance, some team members might use time-tracking applications to discover how long they spend on different tasks. Others might organise their day with a centralised project management system.

If any of your employees are struggling with productivity, it’s important to reach out and find out what’s happening. The problem could be with their schedule and how they organise their day. Alternatively, you could find your employees are experiencing the early stages of burnout. Either way, you can work together to develop a plan to promote the best workflow.

In the age of the “Great Resignation”, and still in the throws of a post-pandemic society, legal professionals have grown more discerning about where, how, and when they want to work.
This shift has meant, by proxy, today’s top talent has endless opportunities for employment, not just from local businesses, but global teams hiring remote employees.

Yet a much documented skills-short market, and a seemingly permanent loss of talent from the labour force means that even despite more flexibility from employers, future employees need to feel ‘wowed’ to have their heads turned.

To thrive in this competitive landscape, business leaders need to know how to create the most compelling job offers, in order to stand out to the most suitable candidates.

The question is, as legal employee preferences and priorities continue to evolve, how do you ensure your job offer has the right impact? Here are some of the top strategies you can use to improve your chances of your candidates saying “yes”.

Culture is growing increasingly important to today’s legal candidates. 46% of employees say company culture is vital to inform their decision of which business to work for. Top performers are consistently attracted to organisations that share their personal values, ethics, and priorities.

From a flexibility perspective, think about how you can adapt to the new working styles of top legal candidates. Many of today’s professionals are looking for opportunities to work from home, even part-time, to give them a better sense of work/life balance – while others also relish the chance to collaborate in an office environment. Are you able to tap into these needs?

You could even go a step further and experiment with concepts like the four-day work week (a pilot of which is running in the UK at the moment) to give your employees the potential of longer, more rejuvenating weekends. One great way to show empathy and flexibility at the same time is to ask your candidates about their specific needs during the interview process.

4. Demonstrate Opportunities for Growth

Today’s lawyers want to know there’s a future in any company they’re going to be working for. According to Gallup, 59% of millennials prioritise opportunities to learn and grow when deciding which jobs to apply for.

Legal Sector Hiring Trends: What Is Happening In The Market

The last few years have certainly seen monumental shifts in the hiring landscape from talent shortages to remote and flexible working.

There is more to come. The impact of the war in Ukraine and rising inflation due to fuel costs and supply chain issues will undoubtedly impact even more candidate decisions to move for more money as the year progresses.

At the end of 2021, there was a record 1.2 million vacancies according to the O.N.S. across all sectors in the U.K. More than fifty per cent of companies reporting staff shortages said they were struggling to fill vacancies.

Unemployment continues to decline, falling to 1.4 million in the three months to October 2021. While unemployment is still above levels before the pandemic, it is now below the average level in the five years before the beginning of quarter one of 2020.

Before we dive into the legal landscape, let us look at recruiting across other sectors first, which naturally will impact the business growth of the legal sector.

The Hiring Trends Index

The hiring trends index reveals that vacancies reached a record high in quarter one, although the growth rate is slowing down compared to the end of last year.

In the recruitment sector, this is known as a candidate-driven market. This is demonstrated by the fact that over forty per cent of businesses have increased their recruitment since the start of the year.

Most companies plan to keep hiring this year, with only 4% planning to decrease recruitment in Q2 2022.

A few points of note from the index, which are present across many legal firms in the U.K., is that companies are seeing an increase of over 20% in hours worked, resulting in one in ten employees leaving because they ‘feel’ overworked. This is connected to over a quarter of employers being concerned about their staff’s mental wellbeing.

All parts add to a complex hiring equation playing out for legal firms across the U.K.

The War For Legal Talent Will Get Worse

In a recent Law.com post, several U.K. law firm leaders were interviewed about their predictions for 2022. The war for legal talent was a key area for discussion on the back of an increasingly dynamic legal landscape in 2022.

Though several leaders predict a slowdown of the transactional surge that occurred in the last half of 2021, they anticipate a rise in restructuring, insolvency, and dispute work, which will continue to fuel what many call an “unsustainable” war between firms to attract the best.

In today’s marketplace, firms need to consider their benefits package overall. Though increased pay rises and higher salaries will carry on, law firms will have to focus more on aspects such as their company culture, the quality of clients they work with and how they look after and develop their staff.

This was backed up by a recent post in The Guardian, where Jon Boys, the labour market economist at the C.I.P.D. confirmed what is happening across the country. Employers are working harder than ever to keep their staff ‘happy’ and do more for them, be that better clients to work with or the option for flexible working.

As a result of market conditions, many firms are coming to the Clayton team seeking advice on how to improve their employer value proposition in the market, from salaries to looking at alternative working patterns that offer greater flexibility.

Work-life balance is no longer simply a buzzword in the H.R. departments of law firms that want to attract the right legal talent for their growth. Working hard is a given in most law firms; however, many legal candidates are actively considering moving to a more empathetic firm that will allow them to create some balance in their lives.

Alison Brown, an executive partner at Herbert Smith Freehills, a respected international firm, when interviewed by Law.com, also commented that firms need to create a culture that appeals to people. Giving people the best work with work-life balance would be the differentiator when legal candidates choose their next employer.

In summary, candidates are willing to move firms, but with an abundance of choice in such a competitive market, it remains a challenge for employers to truly stand out and offer compelling job opportunities in a Firm that has an already strong employer brand, and is able to articulate it’s vision, culture, and wider employer value proposition.

The Wellbeing of Your Law Firm May Need Attention

It’s generally accepted that the legal profession works hard; consistently. Tight deadlines, huge caseloads and out of work hours have always been the accepted norm.

Yet the past few years have seen an explosion in the hours worked by many legal employees as the sector navigated the ups and downs of the pandemic and its concerned client base.

And it is taking its toll.

The Current Mental Health Challenges Legal Employees Are Experiencing

In a recent C.I.P.D. survey, the evidence suggests that the coronavirus pandemic heavily influences employee health and wellbeing.

The virus has and continues to disrupt due to staff absence, and in some cases, employees are suffering the after-effects of contracting the virus from long COVID. Although organisations are still committed to supporting their people, evidence suggests that activity in this area is starting to slip. A more holistic approach – based on the health risks and needs of the workforce – is much needed.

This was also confirmed by a post on Legalcheek at the end of last year that shared research from a Legal Sector Workers United (L.S.W.U.) survey, which reported that 71% of respondents agreed that their role had a negative impact on their mental health with only 14% saying it had a positive effect.

More than half of the respondents had been diagnosed with a specific condition, and almost seven out of ten described themselves as suffering from poor mental health.

The survey of 300 employees, including paralegals, solicitors, barristers, clerks, caseworkers and admin staff.

The main cause of this work-related deterioration in mental health seems to be material conditions in the workplace.

  • 219 people reported struggling to cope with long hours and overwork,
  • 122 cited pay as a key issue,
  • and 113 felt that the relentless pressure to bill and meet targets was a factor.

Shocking stats for all law firms to process, especially when the survey revealed that one in four law firms had no mental health support on offer for staff.

This comment is even more concerning as seven out of ten respondents said they would not feel comfortable asking for time off for mental health reasons and over half commented that disclosing mental health concerns would, in their experience, impede career progression.

It is no wonder that legal professionals are considering the workplace culture of their current firm versus others they could join.

So what can your law firm put in place to improve your legal team’s wellbeing? Here are several ideas.

Assess The Situation in Your Firm

Some of the larger firms we work with conduct a regular employee survey, though historically, asking your team about their wellbeing hasn’t been included.

Consider the nature of the questions you ask employees, and take proactive measures to ensure that respondents are safe from identification. Attempting to measure mental health and stigma in highly challenging environments like an overworked law firm may also skew results so that they are not representative of true employee sentiments.

This is stage one, as it is critical to know what you are dealing with first before you can implement a process to make a difference across your firm

Have Mental Health on Your Agenda

As in all areas of business, if you want an area to change, you must give it focus. I am sure your law firm has a business growth plan and ideas on succession planning, and you may be working with someone like ourselves on building your legal talent pipeline.

Your leadership team will have a strategic plan on how to take the firm forward, and in today’s business landscape, part of that needs to include looking after the wellbeing of your team.

As a first start, you can find some excellent resources on the Mental Health Foundation website here. In addition, assign a partner to the role of mental health lead in your firm. Consider engaging the help of external suppliers to help you implement an Employee Assistance Programme (E.A.P.) which is one part of a wellbeing solution.

E.A.P.s are intended to help employees deal with personal problems that might adversely impact their work performance, health and wellbeing. E.A.P.s generally include assessment, short-term counselling and referral services for employees and their immediate family – wherever they are in the world.

Support Managers To Coach and Lead Their Team

An easy start to improving wellbeing is to instil a coaching culture in your firm aligned with external training on mental health and wellbeing. As a manager trained in wellbeing, you can make a huge difference to your team.

Honest and open communication during regular catch-ups with your team members can help identify struggling people.

We know one law firm uses a traffic light system during conversations with green when everything is ok, amber when a few cracks appear that require help, and naturally, red for an extreme case and that individual needs support. The wellbeing plan has created multiple resources we can all now access to improve our mental health, so finally, I want to share a few examples.

 Provide Support Resources For Your Team

The way we think and listen to our thoughts can cause us to spiral out of control. It is no wonder that working with a coach proves to be a valuable support mechanism for many.

One firm we know utilises the help of an external coach, with team members having the ability to book sessions to help them navigate any stress they are experiencing.

Many of us accept that we lead busy lives, and the ability to handle overwhelm and calm can be facilitated in many ways.

Though it sounds counter-intuitive, there are several online apps that many individuals use with great success. The aptly named Headspace and Calm apps have over a hundred million users and provide access to multiple resources.

Develop Your Action Plan

Finally, improving the well being of your team is about taking action. We have shared several ideas and resources here.

If you’ve never heard of an employer value proposition or brand before, now is the time to expand your education.

According to the CIPD, an employer value proposition is a way your law firm will differentiate itself from competitors when it comes to attracting talent.

The question is, what characteristics do you need to demonstrate to attract talent in the legal sector today?

The U.K. is currently in the grip of one of the worst skills shortages in the last twenty years. Skilled candidates are in the driving seat of their careers, and many will naturally  pick a company based on their brand presence in the market and the narrative related to how they treat their employees.

The last few years have seen talented people re-evaluate their careers and the expectations of the companies they work for. Today, employees will consider moving to get what they want, as highlighted in our recent great resignation post. That might be better pay and conditions, development opportunities and the option to work remotely, amongst other reasons.

Definitions: EVP versus Employer Brand

According to various sources online, employer branding became prevalent in the early 1990s. Since then, it has become a recognised term in both H.R. and recruitment circles.

An employer brand is an impression your law firm gives as a good place to progress your law career to current employees and key players in the external market. From a talent perspective, these would be active and passive candidates.

So, EVP versus employer brand, what is the connection? The CIPD reminds us that we have an employer brand whether we have consciously developed it or not.

If we were to sit around a table and talk about Wetherspoons or Uber, we would all have an opinion about their brand and how they treat their employees.

The employee value proposition for both these brands could potentially do with some work when it comes to their EVP; in other words, “why would I want to work for Uber of Wetherspoons?”.

EVP is, therefore, the conversation and communication points around why I would want to work for this brand.

Building a Stronger EVP

The topic of this post relates to energising your current EVP to attract and keep legal talent.
Fundamentally an employer value proposition is a list of specific and unique benefits an employee can expect to receive when they join your firm.

Vision, motivation, development, acceptance, a diverse and inclusive environment , benefits, pay, wellbeing, and community. The CIPD defines EVP in a simple and jargon-free way: “The value proposition describes what an organisation stands for, requires and offers as an employer.”

Hybrid, Home, and Hub Working in 2022 – What Does The Future Hold?

The world of work has undeniably changed during the last two years. Flexible working opportunities, including work from home, hybrid work, and hub (office) working, are rapidly becoming the new norm.

Consider this alongside the new flexible working bill revealed in June 2021, and work environments might change beyond recognition for firms across the legal sector.

The flexible working bill introduces several considerations for firms in search of talent for 2022. That means evaluating working practices for the legal industry, including if and how people return to the office.

Employers will be required to offer flexible arrangements in employment contracts and explain what work schedules are available when advertising job vacancies.

While the data suggests that employees who work in the professional and commercial sectors, such as law, can be just as efficient in a flexible working environment, the right talent growth strategies will still need to be in place to ensure a firm’s ongoing success.

Fail to provide the right working opportunities, and you could risk losing current staff while having your hiring offers rejected.

For most legal companies, the hybrid working method is likely to be the preferred option for both partners and employees.

Approximately 70% of employees want flexible working options to continue, while 65% require more time with teams. In the legal sector, collaboration in-person and interactions with clients may require staff to be present in the office at least part-time.

Is the Hybrid Working Model Suitable for Legal Sector?

The rise of technology has facilitated a rapid transition to flexible working for many professional service and commercial organisations. E-signatures and contract management tools online allow a lot of the back-end work carried out by legal professionals to happen outside of the office.

Legal employees often feel comfortable working in a hybrid environment, as it allows them to split their time between the office, and the home environment, where they can have more quiet and focus. A recent Thomson Reuters survey reveals that 63% of legal professionals want to work flexible hours now, compared to only 22% pre-pandemic.

Notably, the desire for flexible work doesn’t lead to a decline in job commitment. Lawyers in the U.K. previously worked an average of 10 hours per day on weekdays and now express a desire to work up to 10.1 hours with flexible schedules.

Are There Benefits to New Working Styles?

Working from home, in a hybrid environment, or even as part of a flexible hub appears to have several benefits for today’s legal professionals. With fewer long commutes to worry about, time is saved in getting to and from the office and increased productivity has been documented consistently throughout the last two years.

On top of this, many studies are beginning to indicate hybrid and remote working can positively impact employee engagement satisfaction too.

The ability to work flexibly is something many legal job seekers have as a criterion before considering accepting an offer from a new employer. According to the Microsoft global work trends study, 40% of the worldwide workforce is now thinking about leaving their jobs in exchange for a career with more flexible options.

How to Implement New Work Styles

To ensure your firm stays ahead of the latest trends, it’s critical to start looking at flexible working options that make the most sense for your team. Consider which roles are suitable for hybrid, remote, and hub work and which might require a more traditional schedule.

Hybrid working has multiple benefits, but it can be challenging if not planned correctly. For most firms, the introduction of hybrid working will require a culture shift alongside new working methods.

We can learn lessons from working from home during the pandemic; however, hybrid working will make greater demands of managers and firms on an ongoing basis.

The Great Resignation: Are You Prepared?

In the last couple of years, all segments of the job market have experienced significant changes.

The first stages of the pandemic, in many sectors, resulted in a hold on recruitment. On the other side candidates decided to stay put with their current employer as economic uncertainty took its toll across the UK.

Cycle forward to today and we are looking at a different scenario.

The back pressure of employees who would normally move and the experience of more flexible working options being possible, has resulted in more employees considering a move as confirmed by a number of recent research reports by both Microsoft and Randstad.

A concern for all legal employers; First let us look at the data in more detail.

The Microsoft Work Trend Index report based on over 30,00 responses from Microsoft partners and employees revealed that 46% of respondents plan to move because they can now work remotely.

Confirmation of this move of human capital came from research revealed on a recent Randstad UK, presentation where Christine Armstrong a management consultant and bestselling author shared that 69% of employees felt confident about finding and moving to a new role within a few months.

This was based on data from a poll of over 6000 adults in the UK. The survey found that those in construction, manufacturing, tech, and logistics were among the most confident in the country where 74 % said they felt confident about moving to a new job now.

HR, legal, and accountancy professionals were among the least confident in the country although call centre workers were the least confident at 59%.

The disparity between groups is not huge and it still demonstrates that many people in our workforce are confident about moving to a new job.

Vacancies created by the pandemic, combined with new flexible working options, has created considerable new opportunities for legal professionals. Consequently, Law firms will begin to feel the pressure of the “Great Resignation” in the coming months

Let us explore a few definitions here.

 

What is the “Great Resignation”

The “Great Resignation” is the term used to refer to the increase in the number of people leaving their existing roles after the COVID pandemic.

Factors like excessive burnout during the pandemic, unhappiness with work/life balance, and the rise of new opportunities in most sectors have pushed many employees to reconsider what they now want from their careers.

The number of open jobs in the UK surpassed 1 million for the first time ever in August of 2021, and all industries face a threat. Many job seekers, according to Randstad, are not concerned about the task of actually finding a new role either as they see the number of roles available for skilled employees on multiple job boards and recruitment company websites.

Data provided by the ONS government website shares that around 9% of people changed jobs each year between 2000 and 2018; this ranged from a post-recession low of 5.7% in 2010 to a high of approximately 10.9% in 2017 and 2018.

Logically, you would expect a stall on staff movement in the preliminary stages of Covid, which is what happened; therefore, you would expect a natural upturn in people moving.

But is a mass exit predicted in the headlines simply speculation at this stage? Whilst it is arguably still too early to tell, especially with the latest developments in the ongoing pandemic, figures from ONS’s recent Labour Force Survey (LFS) shows resignations and job-to-job moves are already at their highest in 20 years based on data from quarter 3, 2021. What remains to be seen is the further impact the end of furlough had on the data moving into this final quarter although it is fair to say that the stats so far, alongside the rapid change in employment opportunities for today’s professionals, mean there is enough information available to prompt employers to sit up and take notice.

While not every law firm will necessarily see a mass exodus of staff, all firms will need to be prepared for managing a change in working preferences and expectations.

 

What Can Employers Do?

Even if the great resignation is not having an immediate impact on your firm, legal companies need to be prepared. The problems causing mass resignation in various industries are as significant for law firms as any other sector. Firms will begin to see their talented staff looking for more flexibility, support, and recognition from new employers.

The most valuable thing legal firms can do to stay ahead of the current market is to build their employer brand so that their communication out into the market highlights their culture as a caring and compassionate firm with a commitment to developing their people at their core.

In line with building a compelling brand firms need to be future focussed as they plan for the growth of their team. Though gaps and resignation can occur without warning developing an organisational talent plan can minimise these events.   1. Extending remote work options For many employees in the legal field, the last couple of years has been clear proof the physical workplace is not a necessary ingredient of productivity. Surveys have found 39% of people would consider quitting their role if their employer wasn’t flexible with remote working. Now could be the right time for your firm to consider remote and hybrid working opportunities and how they might work for your team.
  2. Provide the right training Employers and managers need to feel empowered to work well in the existing remote landscape. Managers will need the training to ensure they are still engaging legal teams wherever they might be. Legal professionals may need assistance to use the tools crucial to their remote work practices as effectively as possible. Ongoing training and development will make your team feel like you are investing in them and their future, improving retention.
  3. Improve Workplace Wellbeing Today’s team members are less willing to remain with employers who they feel are not putting their best interests at heart. Today’s staff members are feeling increasingly overwhelmed and burned out in their legal careers. If your legal team feel overwhelmed by work and you are not giving them enough support, they are more likely to look elsewhere. Investing in tools to improve your employee’s well-being and taking their unique needs into account will be essential.

 

What’s Next for Law Firms?

Handling the potential threat of a “great resignation” in the legal industry can be a daunting prospect. Legal professionals can take a lot longer to source, recruit, and onboard than any average staff member, presenting significant problems.

The best way to deal with the great resignation is to get ahead of it as quickly as possible. Assess the sentiment of your legal team towards your culture and determine what kind of things might cause them to seek alternative employment, such as lack of flexible working opportunities or limited recognition from business leaders.

Conducting a series of “stay” interviews rather than waiting for exit interviews should allow you to understand better what is keeping your professionals around.
